SHPE-SV Portal Terms of Service
1. MEMBERSHIP AGREEMENT
The following Terms of Service (referred to as
TOS or “Member Agreement”), are between you and the SHPE-SV Professional
Chapter. The TOS details your rights and obligations as a member of the portal.
Membership. When you pay your membership dues and accept these TOS
you become a SHPE-SV portal user. As a user you are responsible for all
activity on your member account . Violation of these TOS can
result in termination of portal services.
Renewal. Portal services are provide on a yearly basis. The SHPE membership
begins July 1 and expires June 30 of the following year. To continue portal
services, membership dues must be renewed with the SHPE-SV Professional
chapter. Failure to renew will result in termination of portal services.
2. DESCRIPTION OF SERVICE
Description. The SHPE-SV portal provides a web based e-mail address
and storage for a personal website. More services may be added at a later time.
The web based e-mail can be accessed at: http://www.shpe-sv.org/webmail. The URL
for a member website is: http://www.shpe-sv.org/~username,
where username is your login name. Files
can be ftp-ed using an ftp client. The ftp URL is ftp.shpe-sv.org.
3. MEMBER ACCOUNT, PASSWORD, AND SECURITY AND
HACKING/SHARED SERVICE
Member Duty. You will receive a password and member user name. You
agree to keep confidential all passwords and are solely responsible for any
liability or damages resulting from your failure to maintain that
confidentiality. You are also solely and fully responsible and liable for all
activities that occur under your password or member user name. You agree to do
all of the following: (a) immediately notify SHPE-SV if you suspect any breach
of security, such as loss, theft, or unauthorized disclosure or use of your member
user name or password; and (b) ensure that you exit from your account at the
end of each session.
4. MEMBER CONDUCT
You agree that you will NOT use the SHPE-SV portal to:
(a) upload, post, email, transmit or otherwise
make available any Content (as defined below) that is unlawful, harmful,
threatening, abusive, harassing, tortious, defamatory, vulgar, obscene,
libelous, invasive of another's privacy, hateful, or racially, ethnically or
otherwise objectionable;
(b) harm minors in any
way;
(c) impersonate any
person or entity, or falsely state or otherwise misrepresent your affiliation
with a person or entity;
(d) forge headers or
otherwise manipulate identifiers in order to disguise the origin of any Content
transmitted through the SHPE-SV portal;
(e) upload, post, email, transmit or otherwise
make available any Content that you do not have a right to make available under
any law or under contractual or fiduciary relationships (such as inside
information, proprietary and confidential information learned or disclosed as
part of employment relationships or under nondisclosure agreements);
(f) upload, post, email, transmit or otherwise
make available any Content that infringes any patent, trademark, trade secret,
copyright or other proprietary rights ("Rights") of any party;
(g) upload, post, email, transmit or otherwise
make available any unsolicited or unauthorized advertising, promotional
materials, "junk mail," "spam," "chain letters,"
"pyramid schemes," or any other form of solicitation;
(h) upload, post, email, transmit or otherwise
make available any material that contains software viruses or any other
computer code, files or programs designed to interrupt, destroy or limit the
functionality of any computer software or hardware or telecommunications
equipment;
(i) interfere with or
disrupt the SHPE-SV portal or servers or networks connected to the SHPE-SV
portal, or disobey any requirements, procedures, policies or regulations of
networks connected to the SHPE-SV portal;
(j) intentionally or unintentionally violate any
applicable local, state, national or international law, including, but not
limited to, regulations promulgated by the U.S. Securities and Exchange
Commission, any rules of any national or other securities exchange, including,
without limitation, the New York Stock Exchange, the American Stock Exchange or
the NASDAQ, and any regulations having the force of law;
(k) "stalk"
or otherwise harass another; or
(l) collect or store
personal data about other users.
Attempts to Break Security. You understand and agree that any attempt to break
security, or to access an account which does not belong to you, will be
considered a material breach of these TOS, and such breach may result termination
of service, and possibly referral to law enforcement authorities. Unauthorized
access to the SHPE-SV portal, to restricted portions of the SHPE-SV portal, or
to the telecommunications or computer facilities used to deliver the SHPE-SV
portal, is a breach of these TOS whether or not such activities are a violation
of law. Further, you are required to take adequate security measures to
prohibit others from unauthorized access or use of the SHPE-SV portal, and you
must take prompt remedial measures upon notice of breaches, or potential
breaches, of security.
